Summary: Legislation from the 82nd Texas Legislature created an Instructional Materials Allotment for the purchase of instructional materials, technological equipment and technology related services. A school district is entitled to an annual allotment from the state instructional materials fund for each student enrolled in the district on a date during the preceding school year specified by the commissioner. The commissioner shall determine the amount of the allotment per student each year on the basis of the amount of money available in the state instructional materials fund. An allotment under this section shall be transferred from the state instructional materials fund to the credit of the district’s instructional materials account as provided by Texas Education Code Section 31.0212. Districts and open-enrollment charter schools are required to certify annually to the State Board of Education and the Commissioner that, for each subject in the required curriculum other than physical education, students have access to instructional materials that cover all of the Texas Essential Knowledge and Skills (TEKS) and is used only for expenses allowed by the Texas Education Code, Chapter 31.
Budgetary Impact: Districts and open-enrollment charter schools will be unable to place requisitions or disbursement request for the 2025-2026 Instructional Materials and Technology Allotment through TEA Education Material Ordering System (EMAT) until the certification has been received by the Texas Education Agency (TEA).
Recommendation: Recommend approval of the Certification of Provision of Instructional Materials Survey for the 2025-2026 school year as presented.
